NVMCO Group LLC d/b/a OVAL along with our agents, partners, and affiliates (collectively, “OVAL”, “our”, “us”, or “we”) is committed to protecting the confidentiality, privacy, and security of the data of its members, customers, and website visitors. We want you to understand how we collect and use information via our websites, including personally identifiable information, so you can interact with OVAL with confidence. Personally Identifiable Information (“PII”) is data that includes a personal identifier like your name, address, email address, photos, biometric data, and other similar information that can be used to identify you.

This Privacy Notice (the “Privacy Notice”) applies to our web sites, including but not limited to www.OVAL.care (the “Sites”). By proceeding to use the Sites you consent that we may collect, process, and use the data we collect from you in accordance with this Privacy Notice. IF YOU DO NOT ACCEPT THIS PRIVACY NOTICE, DO NOT VISIT ANY OF OUR SITES.

OVAL may, without notice, at any time, revise this Privacy Notice and any other information contained in the Sites. If we materially revise the Privacy Notice, we will revise the “last modified” date at the top of the Privacy Notice and/or notify you by posting a notice on the homepage of our Sites. OVAL may also, without notice, at any time, make improvements or changes in the products, services, or programs described in or included in the Sites. It is your responsibility to check the Privacy Notice periodically for changes. Your continued use of the Sites following the posting of changes will mean that you accept and agree to the Privacy Notice.

Information We Collect

When You Contact Us For Help

If you are an active OVAL customer or member, and you have questions regarding your OVAL program, product or service, please contact your program administrator or testing facility. If you need to contact OVAL directly, please contact us through your OVAL account – please do not contact us through our Sites or social media pages for help with your product or service.

If you are a visitor to our Sites, you should contact info@OVAL.care for help or by submitting an inquiry on the webform available on our Sites. Whenever you contact us for help, we may collect PII such as your name and email address along with any additional information you provide in your request so that we can provide you with assistance. By submitting a request to OVAL, you agree to allow OVAL to use the information you provided, including to contact you in response to your inquiry.

When You Visit a Site

When you use or access our Sites, we may collect and use PII as well as other information such as:

  • Details of your visits to our Sites and the resources that you access, including, but not limited to, traffic data, location data, weblogs and other communication data, including your IP address, browser type, the date and time you accessed or left the Sites, and which pages you viewed. Some parts of our Sites use cookies, pixel tags (also known as “web beacons”), and other technologies to collect this information about your general internet usage.   • Information that you provide directly to us by filling in forms on our Sites, including your name, email address, street address, telephone number, or other information.
  • Information provided to us when you communicate with us for any reason, including information you provide in emails you send us, or submissions you may make to our community or content you post through our social media pages.

Use of Your Information

We use the information we collect from your use of the Sites primarily to enable us to provide the Sites to you in the best possible manner. In addition, your information may be used as follows:

  • Data and logs are used in research to understand and improve the Sites, to troubleshoot the Sites, to detect and protect against error, fraud or other criminal activity, and to enforce our Terms of Use.
  • De-identified data, including data you provide to us via our Sites, may be used to inform the wellness or health-related community about trends, for publication in scientific journals, for product development, in commercial transactions, or for marketing and promotional use. See below to learn more.
  • To provide you, including via your email address, with information relating to the Sites; and
  • To administer our Sites, including by monitoring and analyzing traffic and usage patterns on our Sites.

Sharing Your Information

We only share data about you when it is necessary to provide the Sites, and only as further described below.

Data That Could Identify You

We will only share data that is PII with third parties under the following circumstances:

  • With companies that are contractually engaged in providing us with services, such as service fulfillment, email management, and compiling statistics and reports regarding our audience and the users of the Sites. These companies are obligated by contract to safeguard any PII they receive from us.
  • If we believe that disclosure is reasonably necessary to comply with a law, regulation, valid legal process (e.g., subpoenas or warrants served on us), or governmental or regulatory request, to enforce or apply the Terms of Use, to protect the security or integrity of the Sites, and/or to protect the rights, property, or safety of OVAL, its employees, users, or others. If we are going to release your data under such circumstances, if possible, we will notify you by email of such disclosure, unless we are prohibited by law from doing so.
  • We may disclose or transfer your PII in connection with the sale, merger, bankruptcy, sale of assets, or reorganization of our company. We will notify you of a change in company ownership. This Privacy Notice will still apply to your data as transferred to the new entity.

Such third parties may have access to PII as needed to perform their functions, but they are not allowed to use it for other purposes. We do not sell or rent PII collected through OVAL’s Sites to anyone.

Data That Does Not Identify You (De-identified Data)

OVAL may share aggregated, de-identified, anonymous data, including data you provide to us through our Sites, with third party partners and with the public in a variety of ways, such as, but not limited to, by providing research or reports about fitness, wellness, or health, publishing in academic or scientific journals, using it in product or service development, or in commercial transactions. When we provide this information, we perform appropriate procedures so that the data does not identify you and we contractually prohibit recipients of the data from re-identifying it back to you.

We use cookies and pixel tags as a part of our online experience. Both tools are common digital tracking technologies that, over time, help to enhance the user’s web experience.

A “cookie” is a small computer file that is sent to your computer when you visit a website. The cookie allows that site to recognize your browser on later visits. While cookies may be useful to store user preferences and other information, you can modify cookie preferences or whether you want to use cookies at all. If you refuse to enable cookies, some website features or services may not function properly.

A “pixel tag” is a type of technology placed on a website or within the body of an email for the purpose of tracking activity on websites, or when emails are opened or accessed, and is often used in combination with cookies.

We may use cookies and/or pixel tags to track our users across our OVAL Sites and over time, to improve the user experience on our Sites. We also may use cookies and/or pixel tags to target or personalize marketing, messages, or advertising to our Site visitors.

Third Party Websites and Social Media Features

The Sites may contain links to other sites, including those of third parties or business partners. While we try to only link to sites that share our high standards for privacy, we cannot be responsible for the privacy practices other websites use. By accessing other third party websites or applications through our Sites, you are consenting to the terms and privacy policies of those websites. It is possible that other parties may collect personally identifiable information about you and your online activities over time and across different websites when you use OVAL’s Sites.

OVAL Sites may include social media features. These features may collect your IP address, which page(s) you are visiting on our site, and may set a cookie to enable the feature to function properly. Social media features are either hosted by a third party or hosted directly on our Site. Your interactions with these features are governed by the privacy notice of the entity providing them.

How Long We Save your Data

We may store your information indefinitely.

How do We Keep your Data Secure

We use commercially suitable physical, electronic, and managerial procedures to safeguard and secure the information we collect on our Sites. These procedures include, but are not limited to, firewalls, encryption, intrusion detection, and monitoring. We also limit access to any PII we receive to employees, agents, or partners who need access to that information in order to do their jobs, and hold such employees, agents, or partners to a duty of confidentiality. However, as no data protection procedures can be guaranteed to be 100% secure, there is always a risk of a security breach, and while we strive to protect your personal information, OVAL does not and cannot guarantee that any information provided or collected will not be accessed by unauthorized persons. OVAL is not responsible for circumvention of any privacy settings or security measures that OVAL has established. Your transmission of your data to our Sites thus is done entirely at your own risk.

Your Information

Backups of data that you provide to us through the Sites, such as your email address, will remain in our archive servers. If your information has been shared with a third party, as described elsewhere in this Privacy Notice, then that third party has received its own copy of your data. If you have been contacted by one of these third parties and wish to correct or delete your information, please contact them directly.

Email & Other Communications

We may need to contact you about your use of the Sites. These communications are part of the Sites and you may not opt out from receiving them although you can opt out from receiving other communications (e.g., marketing) from us by contacting info@oval.care. Further, you acknowledge that features of the Sites may, now or in the future, enable your tablet, mobile phone, or other similar device to receive text message (SMS) alerts (the “Text Message Service”). You will be required to opt in to the Text Message Service if you want the Text Message Service activated. OVAL will not charge you for the text message (SMS) alerts you may receive from the Sites. However, message and data rates may apply from your mobile carrier in accordance with your wireless customer agreement with your carrier and you are responsible for any such charges. You should consult your wireless service provider regarding its pricing plans.

International Visitors

OVAL’s Sites are hosted and operated in the United States (“U.S.”). By using the Sites, you are consenting to the transfer of your personal information to the U.S. If you are accessing the Sites from outside the U.S., please be advised that U.S. law may not offer the same privacy protections as the law of your jurisdiction.

California Privacy Rights

California law allows California residents to ask companies with whom they have an established business relationship to provide certain information about the companies’ sharing of personal information with third parties for direct marketing purposes. OVAL does not share any California consumer personal information with third parties for marketing purposes without consent.

Users Only of Legal Age of Majority

Our Sites are designed and intended for those who are at least 18 years old. By using the Sites, you affirm that you are at least 18 years of age or older. Do not use OVAL if you are under 18 years old. We are not liable for any damages that may result from a user’s misrepresentation of age.
